There are cases in which a 14 year old is arrested for stealing a bag of potato chips in the lunchroom or for getting involved in a minor fight on school grounds. Ordinary kid mischief or misbehavior has suddenly been put into the juvenile crime category.
Another common scenario is a party where underage kids are drinking. The larger cities in Johnson County have the resources to devote to what amounts to weekend patrols for underage drinkers. In many of these situations, the police show up without warning to the party and get permission to go inside the house to start questioning kids or make all the kids stay at the house until they get a search warrant to enter, which can take a couple of hours. Once the police are allowed into the house where the party was happening they start asking kids to take a PBT test so that MIP/Minor in Possession of Alcohol charges can be filed. What kids and their parents may not realize is that an MIP not only results in a criminal case being filed against the child, but there can also be driver's license implications if your the child is convicted.
Police Question Kids Without Parents Present
If your child is 14 years old or older, the police have the right to question your teenager without you being there. Most teenagers are intimidated by the police and will often say things that can be used against them. One tactic used by many schools is for the school principal or assistant principal to request the child to come to a room for questioning with the school official and a police officer (often times it is the school resource officer). Once the child confesses, the school official then contacts the child's parents to advise them of the situation. At that point, it may be too late to prevent your child from incriminating themselves.
